Forced Resignation/Constructive dismissal

Sometimes employers ‘fire’ employees indirectly. You will have been constructively dismissed when you ‘voluntarily’ resign from work because the employer has made it very difficult for you to continue in your employment. Indeed, we will help you to claim for lost income, humiliation and hurt feelings. To prove that you have been constructively dismissed we will consider whether:

  • The employer had given you a choice between resigning or being fired.
  • The employer has intentionally behaved in a way that is meant to pressure you to resign and
  • The employer refused to do things he is legally supposed to do. This could be refusing to pay your wages, remove or contain dangerous health and safety hazards from your workplace, excessive workload or failing to protect you from sexual harassment, racial harassment, bullying, violence and so forth.

It can be difficult to win a case on the ground of constructive dismissal so we encourage you to consult experts before you resign.
