ZERO-HOUR CONTRACTS

Backgroundfacts first. New Zealand is a capitalist state like most OECD states and presently our New Zealand type of capitalism is what is called Liberal Market Economy (LME). LMEs have less government regulations; the market mechanism dominates governance and also the relationship between employers and employees. Countries in this category include USA, UK and Australia. On the other hand are, Coordinated Market Economies (CME) which include Germany, France and Sweden. CMEs respect market forces but use nonmarket institutions for governance, including the regulation of employment relations.

Worker and union rights are weak in LMEs but are strong in CMEs. ZERO- HOUR- CONTACTS- agreements that require an employee to be on call and available for work without providing a guarantee of hours or payment in exchange for that availability, have taken New Zealand to the extreme of LME. Zero-hour- contracts places the worker in a vulnerable and disadvantageous position whilst the employer becomes more powerful.

We know that the economic performance of LMEs is not superior to that of CMEs; empirical evidence asserts so. Infect, CMEs performed better than LMEs in recovering from the recent global financial crisis and in employment creation. There is nothing unique about New Zealand’s culture, history and business environment that justifies the LME extreme of zero-hour-contracts.

We advocate for the ban of zero-hour-contracts.
